The President of India, as advised by the Prime Minister, has accepted the resignation of Upendra Kushwaha from the Union Council of Ministers, with immediate effect, under clause (2) of Article 75 of the Constitution.
About:
Article 74 provided for the Council of Ministers. It says that “There shall be a Council of Ministers with the Prime Minister at the head to aid and advise the President who shall, in the exercise of his functions, act in accordance with such advises.”
Article 75 (2) says that” The Ministers shall hold office during the pleasure of the President”.
There are various ways for Removal of council of Ministers –
Upon self-resignation.
Upon dismissal by the President.
Upon direction from the Judiciary for committing violation of law.
Upon ceasing eligibility to be a member of Parliament.
