LIVE STREAMING OF COURT PROCEEDINGS

Supreme Court has agreed to allow live-streaming and video recording of court proceedings. The necessary rules for balancing rights of public and protecting dignity of litigants will be placed soon.

Arguments given by Supreme court:

  • Supreme Court observed that "Sunlight is the best disinfectant". Live-streaming of court proceedings will effectuate the "public right to know" and bring in more transparency in judicial proceedings.

  • This would help people residing in distant places to witness court proceedings, which they otherwise could not have due to logistical issues and infrastructural restrictions.

  • Live-streaming of proceedings would be the true realisation of the “open court system” in which courts are accessible to all.

Conditions laid down:

  • The court will examine the cases where the parties may have genuine reservations and may claim right of privacy and dignity. For this, a just regulatory framework must be provided for.

  • The final decision whether to live-stream a case or not lies with the court, especially in sensitive ones. The decision cannot be appealed.

  • Live-streaming will start as a pilot project in the Supreme Court for cases of constitutional and national importance.
