President’s Rule has come into force in Jammu and Kashmir, after expiry of six months of Governor’s Rule.
Recent development:
The State was placed under Governor’s Rule in June 2018 after the BJP withdrew support to the PDP government led by Mehbooba Mufti.
Since the State has a separate Constitution, in such cases, six months of Governor’s Rule is compulsory under Article 92 of the Jammu and Kashmir Constitution, with all legislature powers vested with the Governor.
The Union Cabinet took the decision after Jammu and Kashmir Governor Satya Pal Malik sent a report recommending imposition of President’s Rule in the State. After the proclamation, the powers of the legislature shall be exercisable by or under the authority of Parliament.
Difference from other states:
In other states, the Centre invokes Article 356 to impose President’s rule.
In J&K, under Section 92 of the J&K Constitution, the Governor can rule for six months with a set of powers, the only requirement being the President’s consent.
