Answer:

The recent crackdown by the Assam government on child marriages is being made under the Protection of Children from Sexual Offences Act (POCSO) and the Prohibition of Child Marriage Act (PCMA). The government is also amending the PCMA to raise the marriageable age for women across all religions from 18 to 21.

The Protection of Children from Sexual Offences (POCSO) Act is a comprehensive law in India to protect children from sexual abuse and exploitation to protect children from sexual abuse and exploitation through legal provisions and severe punishment. The following are its key provisions:

  • Definition of Child Sexual Abuse: It defines different forms of sexual abuse, including penetrative and non-penetrative sexual assault, sexual harassment, and exploitation.
  • Protection of Child Victims: Provisions for the protection of child victims during investigation and trial, including special measures for their physical, psychological, and emotional well-being.
  • Time-bound Trial: Mandatory completion of trial within a period of one year.

A 2022 analysis by Vidhi Centre for legal policy states that 43.44 percent of trials end in acquittals and only 14.03 percent lead to convictions.
  2. Insufficient protection for children in conflict areas: It does not adequately address the needs of children in conflict areas, who are at high risk of sexual violence and exploitation.
  3. Insufficient protection for LGBTQ children: POCSO does not provide special provisions for protection for lesbian, gay, bisexual, transgender, intersex, or queer/questioning children, who are often subjected to abuse and exploitation.
  4. Inadequate support for child survivors: POCSO provides inadequate support for child survivors, who often face barriers in accessing healthcare, legal services, and other forms of support.
  5. Lack of training for law enforcement: Law enforcement officials often lack the training and resources needed to effectively implement the provisions of the POCSO Act.
  6. Stigma and discrimination: Stigma and discrimination against child survivors often lead to a lack of reporting of abuse and a lack of accountability for perpetrators.

Thus, there is a need for a multifaceted approach to ensure the protection and safety of children:
